उत्तराखंड हाईकोर्ट ने देहरादून में महिला की संपत्ति पर अवैध कब्जा कर निर्माण करने के मामले में बार बार शिकायत के बाद भी कार्यवाही नहीं करने को बहुत ही गंभीरता से लिया है। मुख्य न्यायाधीश की अध्यक्षता वाली बैंच ने इतने गंभीर मामले में बार बार शिकायत करने के बावजूद हीलाहवाली करने पर एसएसपी, कोतवाल ओर एमडीडीए पर एक-एक लाख रुपये का जुर्माना लगाया है। हाईकोर्ट ने कहा हैं कि दो सप्ताह के भीतर जुर्माने की राशि याचिकाकर्ता को न देने पर अवमानना की कार्रवाई होगी।
साथ ही एसएसपी, कोतवाल ओर एमडीडीए को जुर्माने की राशि वेतन से देनी होगी, यदि तय अवधि में जुर्माने की धनराशि का भुगतान नहीं किया गया तो जिलाधिकारी देहरादून को राजस्व वसूली के तहत कार्रवाई कर जुर्माने की वसूली करनी होगी।
देहरादून निवासी सविता गुप्ता ने हाईकोर्ट में याचिका दायर कर कहा था कि देहरादून स्थित पलटन बाजार में उनकी दुकान है तथा उन्होंने अपनी दुकान तो बेच दी थी परंतु उसकी छत नहीं बेची थी तथा दुकान खरीदने वालों सौरभ गुप्ता, गौरव गुप्ता व हरीश गुप्ता ने छत पर कब्जा कर बिना उनकी अनुमति के अवैध तरीके से निर्माण कर लिया।
याचिकाकर्ता महिला सविता गुप्ता का कहना था कि पहले 2019, फिर दिसंबर 2020 में उसने एमडीडीए, एसएसपी व इंस्पेक्टर कोतवाली से शिकायत की थी लेकिन कोई कार्रवाई नहीं हुई। जिसके बाद हाईकोर्ट में याचिका दायर की गयी । हाईकोर्ट की एकलपीठ ने इसी साल जनवरी में याचिका खारिज करते हुए सिविल वाद दायर करने का आदेश दिया था। एकलपीठ के इस निर्णय के खिलाफ सविता गुप्ता द्वारा विशेष अपील दायर की गयी । इस विशेष अपील को दायर करने के बाद हाईकोर्ट ने एसएसपी, कोतवाल व एमडीडीए के अफसरों को तलब किया था।
सोमवार को मुख्य न्यायाधीश न्यायमूर्ति राघवेंद्र सिंह चौहान व न्यायमूर्ति आलोक कुमार वर्मा की खंडपीठ में दून एसएसपी योगेन्द्र सिंह रावत व देहरादून कोतवाली के कोतवाल शिशुपाल सिंह नेगी हाईकोर्ट में पेश हुए तथा एमडीडीए की ओर से कहा गया कि 28 दिसंबर 2020 व 15 जनवरी 2021 को सीलिंग का नोटिस दिया गया था। साथ ही यह भी कहा कि पुलिस फोर्स मांगने के बाद भी हमे पुलिस फोर्स उपलब्ध नहीं करवाई गई। इस पर नाराज कोर्ट ने कहा कि डीजीपी को पत्र क्यों नहीं लिखा। जब कोई घटना घट जाती है तब पुलिस कार्रवाई करती है।
Due to non decisiveness in Government departments and excessive interference in day to day administration by street politicians through their masters has crippled our system and their is intense rise in cases in honble high court.This has created such situation that it appears that soon even the casual leave aplication of a clerk or officer will be sanctioned by honble court due to paralysis of system.
Instead of monitoring each desk work daily closely on files , reducing pendency of issues and aplications to zero level most of the head of departments , officers and secretaries are runing whole day to minister for getting highlighted and attendibg their useless meetings without any predetermined indicators. The routine work is ever day pending in offices as all top bosses are in meeting every day.This hapoens more when a new CM comes as every body runing to brief him.No body in deoartments is taking interest in disiplining the staff and getting assigned work done and improving performance every day.
over the above no delegation of financial and administrative powers to lower flankes has created situation beyond repair.
Until the top leadership of state doesnot starts direct feedback from field, every office and about every officer on day to day basis nothing will reflect as a change of the leadership. Only publicity in newspapers , hordings, TV channel will not work as people are fed up with these tactics and they want to see visible changes in form of availabiity of foot paths, safe drinking water, fine health care, good primary education, excellent transport, cleaniness in towns, high class law and order, courteseous quick function at each of the office of state specially public counters, want to see senior officers and minister not visiting at these counters for their publicity but actually sit there and work some time sorting out problems and improving system and public facilities all round.
This may take time, but hopefully the BJP which level it self biggest think tank disiplinned party may have developed a road map for development of Uttarakhand with this fresh change of leadership in the state, if not it will also go the same end as congress which ruled the country more than 70 years.
